Public Offer Agreement

This document is an official offer (public offer) by Individual Entrepreneur Denis Alekseevich Glushenkov to enter into an agreement under the terms below.

By accepting the terms and paying for services, the person becomes a User.

1. Terms and Definitions

1.1. Service (Platform) - the «Trendly» software product, located at: https://trendly.video/, intended for searching trending YouTube videos by keywords.

1.2. Tariff - the cost and conditions of providing access to the Service's functionality published on the Website.

1.3. Personal Account - a secure section of the Website created for the User after registration.

2. Subject of the Agreement

2.1. The Contractor undertakes to provide the User with access to the Service's functionality according to the selected Tariff.

2.2. The Service provides tools for searching and analysing trending videos by keywords using publicly available data obtained from open sources and via third-party application programming interfaces (APIs).

2.3. Access is provided via the Internet (SaaS model).

3. Data Sources

3.1. The Service uses publicly available information about videos and channels (titles, view statistics, channel data, etc.) obtained in an automated manner from open sources and via third-party application programming interfaces (APIs).

3.2. The Service does not access the private portions of the User's accounts on video platforms and does not request such permissions.

3.3. The "Virality" metric displayed in the Service is calculated by Trendly itself based on public data (views, subscribers) and is not an official metric of any video platform.

4. Procedure for Providing Services

4.1. To gain access to paid features, the User goes through the registration procedure on the Website.

4.2. Services are considered duly rendered from the moment of providing access to paid features.

5. Rights and Obligations of the Parties

5.1. The Contractor has the right to make changes to the Service's functionality and Tariffs.

5.2. The Contractor has the right to temporarily suspend the Service for technical work.

5.3. The User undertakes to use the Service only for lawful purposes, in accordance with this Offer and the YouTube Terms of Service.

6. Cost and Payment Procedure

6.1. The cost is determined by the Tariffs on the Website.

6.2. Payment - 100% prepayment.

6.3. Refunds for activated access are not provided.

7. Liability of the Parties

7.1. The Service is provided «AS IS».

7.2. The Contractor is not responsible for changes in third-party APIs and data sources used by the Service.

8. Personal Data

8.1. The User consents to the processing of personal data in accordance with Federal Law No. 152-FZ and the Privacy Policy published at: /en/privacy/

9. Term of Validity

9.1. The Offer is valid from the moment of publication until withdrawn by the Contractor.
