Public Offer Agreement

This document is an official offer (public offer) by Individual Entrepreneur Denis Alekseevich Glushenkov to enter into an agreement under the terms below.

By accepting the terms and paying for services, the person becomes a User.

1. Terms and Definitions

1.1. Service (Platform) — the «Trendly» software product, located at: https://trendly.video/, intended for searching trending YouTube videos by keywords.

1.2. Tariff — the cost and conditions of providing access to the Service's functionality published on the Website.

1.3. Personal Account — a secure section of the Website created for the User after registration.

2. Subject of the Agreement

2.1. The Contractor undertakes to provide the User with access to the Service's functionality according to the selected Tariff.

2.2. The Service provides tools for searching and analysing trending YouTube videos by keywords using publicly available data from YouTube API Services.

2.3. Access is provided via the Internet (SaaS model).

3. Use of YouTube API Services

3.1. The Service uses YouTube API Services to obtain publicly available YouTube data.

3.2. By using the Service, the User agrees to be bound by the YouTube Terms of Service: https://www.youtube.com/t/terms. Agreement with the YouTube Terms of Service is a mandatory condition for using the Service.

3.3. By using the Service, the User confirms that they have read the Google Privacy Policy: http://www.google.com/policies/privacy

3.4. The User has the right at any time to revoke the Service's access to their Google/YouTube data via Google security settings: https://security.google.com/settings/security/permissions

3.5. In case of any discrepancy between this Offer and the YouTube Terms of Service — the YouTube terms shall prevail.

3.6. The "Virality" metric displayed in the Service is calculated by Trendly based on public YouTube API data and is not a YouTube metric.

4. Procedure for Providing Services

4.1. To gain access to paid features, the User goes through the registration procedure on the Website.

4.2. Services are considered duly rendered from the moment of providing access to paid features.

5. Rights and Obligations of the Parties

5.1. The Contractor has the right to make changes to the Service's functionality and Tariffs.

5.2. The Contractor has the right to temporarily suspend the Service for technical work.

5.3. The User undertakes to use the Service only for lawful purposes, in accordance with this Offer and the YouTube Terms of Service.

6. Cost and Payment Procedure

6.1. The cost is determined by the Tariffs on the Website.

6.2. Payment — 100% prepayment.

6.3. Refunds for activated access are not provided.

7. Liability of the Parties

7.1. The Service is provided «AS IS».

7.2. The Contractor is not responsible for changes in third-party APIs, including YouTube API Services.

8. Personal Data

8.1. The User consents to the processing of personal data in accordance with Federal Law No. 152-FZ and the Privacy Policy published at: /en/privacy/

9. Term of Validity

9.1. The Offer is valid from the moment of publication until withdrawn by the Contractor.
